Business Associate Agreement
Last updated: April 2026
What is a BAA?
A Business Associate Agreement (BAA) is a legal contract required by HIPAA between a healthcare provider (your agency) and any vendor that handles Protected Health Information (PHI) on your behalf. Tendara handles PHI as part of our service, so a BAA is required.
How Tendara handles BAAs
Every Tendara agency receives a signed BAA before accessing the platform. This is automatic and non-negotiable — you don't need to request it. The BAA is part of your account setup process.
What our BAA covers
- Tendara's obligations to protect PHI under HIPAA and HITECH
- Permitted uses and disclosures of PHI
- Encryption and security safeguards we maintain
- Breach notification procedures and timelines
- Your rights to audit and request PHI accounting
- Termination provisions and data return/destruction
